On 10 January 2017, the Singapore Parliament passed into law its Civil Law Amendment Bill which effectively allows third-party to finance international commercial arbitration. This not only further reinforce Singapore’s position as a very strong international arbitration & dispute resolution hub but continue to significantly strengthen the importance of arbitration as the primary method of transnational commercial dispute resolution.
In theory, the funding allows a party who has a legitimate claim against another but without the financial resources to seek funding from funding providers, for Singapore seated arbitration. This can potentially offer disputants the opportunity to finance their valid claims which they may otherwise cannot afford to do so financially.
